Conditions for using The Social Work Campfire

The Social Work Campfire: Rules for Using Our Service

These are the rules (we'll call them "Conditions") for using the Social Work Campfire website or mobile app (we'll call both the "App").

  • "We," "us," or "our" refers to The Child Safeguarding Decision Lab Limited, the company providing the App.
  • "You" or "your" refers to you, the person using the App.

1. Agreeing to the Rules

  • Your Agreement: By using the App, you're agreeing to follow these Conditions and our separate Privacy Policy.

  • If You Don't Agree: If you don't accept these Conditions or our Privacy Policy, please stop using the App and don't log in.

  • Questions? If you have any questions about these rules, email us at admin@safeguardinglab.co.uk.

  • Updates to the Rules: We might change these Conditions sometimes. If we do, we will notify you by email. The updated rules will apply as soon as they are posted. If you don't agree with the changes, you have the right to stop using the App. It's your responsibility to check these Conditions regularly to see if anything has changed.

  • Who We Are: The App is provided by The Child Safeguarding Decision Lab Limited, a company registered in England and Wales.

2. Using Our App

  • What You Can Do: If you follow these rules, you're allowed to use the App on your devices to:
    • Answer survey questions ("Questions").
    • View information in the App, like daily results from the Questions, our reports, and news summaries ("App Content").
    • You can only do this for your own personal use, not for business or making money.
  • Be Honest: Answer the Questions honestly and as accurately as you can.
  • Your Personal Use Only: We're giving you (and only you) permission to use the App. You can't give the App or your access to someone else. Don't sign up using someone else's name.
  • Age Requirement: You must be 18 or older to use the App.
  • What Happens to Your Answers: When you answer Questions, you allow us to copy, store, and use those answers. We do this to display results within the App and for our business purposes, like creating reports for clients (see rule 2.7 below).
    • Anonymity: Usually, your answers will be anonymous, meaning no one can directly link them back to you.
    • Potentially Identifiable Data: If we combine your answers with other information in a way that could identify you (we'd need your specific permission for this), we will treat that information as personal data according to our Privacy Policy.
  • Permission for Anonymous Answers: For answers where your identity isn't revealed, you give us a permanent, worldwide, free right to use, copy, display, share, translate, and adapt them for any purpose related to the App or promoting it. This permission is irrevocable (can't be taken back) and allows us to let others use it too.
  • Permission for Identifiable Answers: If we use your answers in a way that might reveal your identity (which requires your specific consent), you give us the same permissions as above. However, this is always subject to your ongoing consent and our Privacy Policy. You can withdraw your consent at any time. If you do, we will stop using your answers in any way that could identify you.
  • Follow Instructions & Updates: Please follow any reasonable instructions we give you about using the App. We might provide updates or new versions of the App.
  • What You CANNOT Do: You must not do (or help anyone else do) any of the following:
    • View, copy, or use any App Content except for your personal use as described in rule 2.1.
    • Translate, take apart, figure out how the App is built (reverse engineer), copy, or create new versions based on the App (unless the law specifically allows it).
    • Change, adapt, or add things to the App or its content, even to fix errors.
    • Mix the App with other software or code.
    • Rent, sell, share, loan, lease, or give the App or App Content to anyone else.
    • Try to hack or weaken the App's security.
    • Use the App to create a similar or competing service.
    • Make the App or its content available online for others to access freely (like on the internet or a company intranet).
    • Remove any copyright or ownership notices from the App or its content.
    • Try to get other users' information or do anything that could cause the App to crash or stop working properly.
  • Your Responsibility: You are responsible for how the App is used on your device. Tell us right away if you think someone is using the App or its content without permission, and help us stop it if you can.
  • Who Owns What: We own all the legal rights (like copyright, trademarks, patents, etc., called "IP Rights") to the App itself, the Questions, the App Content, and all the data collected through the App (except for your own individual answers). You are only getting a license (permission) to use the App and its content; you don't own it.
  • Third Parties: We might allow other companies or organisations ("third parties") to:
    • Sponsor some of the Questions.
    • Access our collection of past data (usually anonymous).
    • Advertise their products or services within the App.
  • Research Activities: Sometimes, we might conduct research aiming to influence user behaviour (like around well-being). If we do this, we will always ask for your specific permission first ("opt-in") and give you a clear way to stop participating ("opt-out"), according to our Ethics and Values Policy.

3. App Availability

  • Efforts to Keep it Running: We'll try our best to keep the App available for you to use all the time. However, sometimes access might be interrupted due to planned updates, emergency repairs, or problems with internet connections or equipment that are out of our control.
  • Changes to the App: We have the right to remove any content or features from the App at any time, for any reason, without warning you first. We won't be responsible to you if we do this.
  • Your Costs: You are responsible for paying any internet, mobile data, or other charges you have to pay while using the App.

4. Our Promises, Disclaimers, and Limits on Responsibility

  • Our Basic Promise: We promise to provide the App service with reasonable skill and care.
  • App Content is Informational Only: The information in the App ("App Content") is just for general information. It's based on user answers and other sources, so it might sometimes contain mistakes, be incomplete, or not be up-to-date. As far as the law allows, we are not responsible or liable for how you use the App or the App Content, or for any decisions you make based on it.
  • Device Damage: If a problem with our App damages your device or other digital content because we failed to use reasonable skill and care, we will either fix the damage or pay you compensation up to £20 per device (you'll need to provide proof). However, we won't be responsible for damage caused because you didn't follow these Conditions.
  • Important Legal Limits: Nothing in these Conditions limits or removes our responsibility for things that the law says we must be responsible for (like death or injury caused by our carelessness, or fraud).
  • Unavoidable Delays: If providing the App is delayed or interrupted by something outside our control (like a major power outage), we will try to lessen the impact. As long as we do this, we won't be responsible for delays caused by the event.

5. Ending Your Use of the App

  • How it Can End: Either you or we can decide to end your access to the App at any time. We just need to give each other written notice (like an email or an in-app message).

  • What Happens When it Ends: If your right to use the App ends, you must immediately stop using it and delete it from all your devices. We might also remotely stop your access.

  • How to Delete Your Account: If you want to delete your Social Work Campfire account, you can:

    • Use the 'delete account' option within the App; OR
    • Send us a message including the email address you used for your account.
  • Your Data After Termination: Our Privacy Policy explains how we handle your personal data after your account is closed.

6. Other General Rules

  • The Whole Agreement: These Conditions contain the entire agreement between you and us about using the App. They replace any previous agreements or discussions on the subject.

  • Transferring Rights: You cannot give your rights or responsibilities under these Conditions to someone else without our written permission. We can transfer our rights and responsibilities to another company or person, and we will let you know if this happens.

  • Enforcing the Rules: Even if we delay in enforcing any part of these Conditions, we can still enforce it later.

  • If a Part is Invalid: If a court decides that any part of these Conditions is illegal or unenforceable, the rest of the Conditions will still apply.

  • Our Relationship: These Conditions don't create any kind of partnership, joint venture, or agency relationship between you and us. Neither of us can act like we represent the other or make promises for the other.

  • Governing Law: These Conditions are governed by the laws of England.

  • Where Legal Disputes Happen: Any legal disagreements about these Conditions will normally be dealt with in the courts of England and Wales. However, if you live in Northern Ireland or Scotland, you can choose to bring legal action in your local courts instead.
